What types of information do we collect, how do we use it and why?
Diamond Geriatrics collects two types of information from its users: (1) information you knowingly choose to disclose (i.e. your voluntary information); and (2) computer information automatically collected by us, such as IP addresses, as you interact with the website.
We collect two types of voluntary information: (1) business contact information (the “Business Contact Information”) and (2) personally identifiable information (the “Personally Identifiable Information”). Business Contact Information means information that would enable you to be contacted at your place of business and includes your name, position, business telephone and facsimile numbers, business address, and business email. Business Contact Information is not covered by this Privacy Policy.
Personally Identifiable Information means information about you as an individual such as your name, age, home address, telephone number(s), medical information, special needs, work experience, résumé, etc. Personally Identifiable Information does not include Business Contact Information.
We will only collect, use, and disclose Personally Identifiable Information that is necessary to fulfill the following purposes: to verify identity; to match users with other users; to verify credit-ratings; to identify user preferences; to understand the personal needs of our users; to open and manage an account; and to ensure a high standard of service to our users.
We do not knowingly collect Personally Identifiable Information from persons under 19 years old. Persons under 19 are not permitted to use this site.
With respect to the computer information we collect, we automatically collect some non-personally identifiable information such as the type of computer operating system (e.g. Windows XP, Windows Vista or Mac OS), the user’s IP address, the web browser being used (e.g. Netscape, Firefox or Internet Explorer), information regarding the Internet service provider, and Cookies.
Cookies are a technology that stores a small amount of information on your computer to allow the website to recognize you for future visits to the website. We use Cookies to obtain information about the preferences of our users and the services they select. We also use Cookies for security purposes to protect our members. For example, if a user is logged on and the site is unused for more than 10 minutes, we will automatically log the member off. Cookies enhance the convenience and use of the website.
Must you consent to Diamond Geriatrics collecting, using, and disclosing your Personally Identifiable information?
We will obtain user consent to collect, use or disclose Personally Identifiable Information except in certain circumstances where we are authorized to do so without consent.
Usually, your consent will be implied because the purpose(s) for which we are collecting or disclosing the information will be clear and obvious and the user voluntarily provides Personally Identifiable Information for that purpose. For example, you may be asked to provide Personally Identifiable Information regarding your preferred recreational activities so that other users with similar interests can connect with you. It is clear that this information will be disclosed to other users to better facilitate the Diamond Geriatrics service, and it is clear that you voluntarily (i.e. consent to) provide the Personally Identifiable Information for that purpose.
Consent may also be implied where a user is given notice and a reasonable opportunity to opt-out of his or her Personally Identifiable Information being used for mail-outs, marketing, etc. and the user does not opt-out.
We may collect, use, and disclose Personally Identifiable Information without your knowledge or consent in the following limited circumstances: as permitted or required by law (e.g. court order, subpoena, a valid request form a law enforcement agency); in an emergency that threatens your health or safety; where the information is available from a public source (e.g. a phone book); and for legal advice.
Can you withhold or withdraw your consent to Diamond Geriatrics collecting, using, or disclosing your Personally Identifiable Information?
Subject to certain exceptions (e.g. the information is necessary to provide the service, or withdrawal of consent would frustrate the performance of a legal obligation), users can withhold or withdraw their consent for Diamond Geriatrics to collect, use, or disclose their Personally Identifiable Information in certain ways. For example, users may opt out of receiving unsolicited information from, or being contacted by, us and/or our vendors and affiliated agencies by responding to emails as instructed, or by contacting us at [email address]. Of course, a user’s decision to withhold or withdrawal his or her consent to certain uses of Personal Identifiable Information may restrict our ability to provide a particular service. In such cases, we will explain the circumstances to assist the user in making the decision.
Does Diamond Geriatrics share your Personally Identifiable Information with third parties?
Diamond Geriatrics does not share Personally Identifiable Information with third parties, except where it is necessary to offer the service, legally required, or with user consent. We do not use Personally Identifiable Information for marketing purposes, except for newsletters from Diamond Geriatrics or its affiliates and with user consent.
Third party advertisements may appear on Diamond Geriatrics at any point in the future without notice to the user. By using Diamond Geriatrics, advertisers may automatically receive your IP address. These third party advertisers may also download cookies to your computer, or use other technologies such as JavaScript to measure the effectiveness of their ads and to personalize advertising content. Diamond Geriatrics does not have access to or control of the cookies that may be placed by the third party advertisers. Third party advertisers have no access to your Personally Identifiable Information stored on Diamond Geriatrics, unless you choose to share it with them. This Privacy Policy covers the use of cookies by Diamond Geriatrics and does not cover the use of cookies or other tracking technologies by any of its advertisers.
Diamond Geriatrics may contain links to other websites. When you click on one of those links you are contacting another website. We are not responsible for the privacy practices of other web sites. This Privacy Policy applies solely to information collected by Diamond Geriatrics.
How long do we retain your Personally Identifiable Information?
Generally, we will retain your Personally Identifiable Information only as long as necessary to fulfill the purpose(s) outlined above. If we use Personally Identifiable Information in a way that directly affects the user, we will retain your Personally Identifiable Information for a reasonable period of time, so that you have a reasonable opportunity to request access to your Personally Identifiable Information.
How can you correct any inaccuracies in your Personally Identifiable Information?
To update or correct your Personally Identifiable Information, you may contact us at eldercare@diamondgeriatrics.com. All requests must be made in writing and provide sufficient detail to identify the Personal Identifiable Information and the correction or update being sought.
Can you delete or deactivate your Personally Identifiable Information collected by Diamond Geriatrics?
We provide users with a mechanism to delete or deactivate Personally Identifiable Information from the website’s database by contacting us at eldercare@diamondgeriatrics.com. However, because of backups and records of deletions, it may be impossible to delete a user’s entry without retaining some residual information. A user who requests to have Personally Identifiable Information deactivated will have this information functionally deleted, and we will not sell, transfer, or use the user’s Personally Identifiable Information.
Can you right access your Personally Identifiable Information?
Users have a right to access their Personally Identifiable Information, except in limited circumstances such as information subject to solicitor-client privilege; disclosure that would reveal another user’s Personally Identifiable Information; information that if released would cause health and safety concerns. You may make a request for access to your Personally Identifiable Information by contacting us at eldercare@diamondgeriatrics.com.
Upon request, which must be made in writing and provide sufficient detail to identify the personal information being sought, we will provide the user with his or her Personally Identifiable Information we have collected, how we use it, and to whom it has been disclosed if applicable.
We will endeavour to respond to your request within 30 days of receipt of your request. In some circumstances, we may extend our response time by an additional 30 days. A minimal fee may be charged for providing access to your information; however, you will be notified of the fee and we will obtain your consent to proceed before we process your request. If we refuse your request for any reason, we will provide you with written reasons for doing so.
How does Diamond Geriatrics ensure Personally Identifiable Information is secure?
All of our employees are familiar with our security policy and practices. The Personally Identifiable Information of our users is only accessible to a limited number of qualified employees who are given a password in order to gain access to the information. We audit our security systems and processes on a regular basis. Sensitive information, such as credit card numbers or social security/insurance numbers, is protected by encryption protocols, in place to protect information sent over the Internet. While we take commercially reasonable measures to maintain a secure website, electronic communications and databases are subject to errors, tampering and break-ins, and we cannot guarantee or warrant that such events will not take place and we will not be liable to users for any such occurrences.
We will use appropriate security measure when destroying Personally Identifiable Information such as deleting electronically stored information and shredding documents.
What happens if the Privacy Policy changes?
We will endeavour to let our users know about changes to the Privacy Policy by posting such changes to the Privacy Policy. However, if we are changing our privacy policy in a manner that might cause disclosure of Personally Identifiable Information that a user has previously requested not be disclosed, we will contact the user to allow him or her to prevent disclosure of his or her Personally Identifiable Information. Diamond Geriatrics reserves the right to change its Privacy Policy at its sole discretion without express notice. You are responsible to check the Privacy Policy for any changes.
When is the Privacy Policy effective?
The Privacy Policy set out above is effective as of January 1, 2018, and applies to all information previously obtained by Diamond Geriatrics.
